AP president calls on Obama to ‘rein in’ DOJ probe into wire service’s records

Associated Press President Gary Pruitt says the Justice Department sent a strong – and negative — message to future sources that the government would go after them if they spoke to the press. It’s a move Pruitt called not only unconstitutional, but damaging to the ideal of a free press in the country in his first television interviews on the scandal Sunday.

In a separate interview with the AP, Pruitt said, “It’s too early to know if we’ll take legal action but I can tell you we are positively displeased and we do feel that our constitutional rights have been violated.”

He said President Obama “should rein in that out-of-control investigation.”

“They’ve been secretive, they’ve been overbroad and abusive — so much so that taken together, they are unconstitutional because they violate our First Amendment rights,” he added.

Although the Justice Department has not explained why it sought phone records from the AP, Pruitt pointed to a May 7, 2012, story that disclosed details of a successful CIA operation in Yemen to stop an airliner bomb plot around the one-year anniversary of the May 2, 2011, killing of Usama bin Laden.

The AP delayed publication of that story at the request of government officials who said it would jeopardize national security.

“We respected that, we acted responsibly, we held the story,” Pruitt said.

Pruitt said the AP published the story only after officials from two government entities said the threat had passed. He said the administration still asked that the story be held until an official announcement the next day, a request the AP rejected.

The news service viewed the story as important because White House and Homeland Security Department officials were saying publicly there was no credible evidence of a terrorist threat to the U.S. around the one-year anniversary of bin Laden’s death.

“So that was misleading to the American public. We felt the American public needed to know this story,” Pruitt said.

The AP has seen an effect on its newsgathering since the disclosure of the Justice Department’s subpoena, Pruitt said on CBS’ “Face the Nation.”

“It will hurt,” he said. “We’re already seeing some impact. Officials are saying they’re reluctant to talk.”

The Justice Department sought phone records for a two-month period from more than 20 phone lines in four bureaus, including Washington and New York.  

“Their rules require them to come to us first,” Pruitt said.

But the Justice Department maintains that telling the AP would have posed a threat to their investigation.

Last week, Attorney General Eric Holder faced aggressive questioning at a hearing by the GOP-led House Judiciary Committee amid the outcry over the gathering of phone records.

Holder said he had recused himself from the AP investigation and that it was Deputy Attorney General James Cole’s decision to authorize the subpoena. Holder had said he supported the decision and said that the department had seized the phone records in an effort to find out who leaked confidential information about a foiled terror attack in Yemen.

The DOJ went a step further and said the AP’s actions put Americans at risk, something the news organization strongly refuted.

“Rather than talk to us in advance, they seized these phone records in secret, saying that notifying us would compromise their investigation,” Pruitt said in a statement on the AP’s website.

Sen. John Cornyn, who was also on “Face The Nation,” called for Holder’s resignation. “I think it’s time for him to go,” he said.

3 more suspects taken into custody in Boston bombing case, police say

Three additional suspects were taken into custody in the Boston Marathon bombing case, the Boston Police Department tells FoxNews.com. 

Police would not confirm when the suspects were taken into custody, and referred further questions to the FBI.

Prior to the latest development, authorities had named only brothers Tamerlan and Dzhokhar Tsarnaev as suspects in the April 15 bombing at the finish line of the world famous race.

Two of Dzhokhar Tsarnaev’s former UMass-Dartmouth classmates, Dias Kadyrbayev and Azamat Tazhayakov, are from Kazakhstan and faced an immigration hearing this morning, sources said. Sources told Fox News they face obstruction charges in connection with the bombing. The identity of the third suspect is unclear.  

Kadyrbayev and Tazhayakov are suspected of taking computers and other equipment from Dzhokhar Tsarnaev’s apartment and trying to dispose of it after the bombings, sources told Fox News.

Kadyrbayev’s attorney Robert Stahl says his client will be transported to the federal courthouse later Wednesday to appear on new criminal charges. On Friday, Yerlan Kubashev with the Consulate General for Kazakhstan in New York confirmed in a statement to Fox News that the consulate is helping the young men with legal representation.

Kubashev said the two men are “shocked at the bombings,” and “they express sorrow to the bombing victims and their families.”

Police did not confirm the gender of the third suspect, but Fox News confirmed the person is a U.S. citizen. More information was expected to be provided by the US Attorney’s office later Wednesday.

Three people were killed and more than 200 injured when the pair allegedly set two bombs, at least one of which was made from a pressure cooker packed with explosives and shrapnel, amid the crowd. 

Tamerlan Tsarnaev died April 19, after a shootout hours after authorities showed the brothers on surveillance video and named them as suspects.  Dzhokhar Tsarnaev, 19, is in a prison hospital after being wounded in the shootout with police as he and his brother made their getaway attempt. He is charged with using a weapon of mass destruction to kill, a crime that carries a potential death sentence.

Authorities have searched the Rhode Island home of the parents of Katherine Russell, Tamerlan Tsarnaev’s widow.

FBI, Boston police go into overdrive in marathon bombing probe

The FBI and state and local police are intensifying their probe into Monday’s bombing at the finish line of the Boston Marathon, vowing a “worldwide investigation” and appealing to the public for tips and cellphone pictures that might yield clues about who was behind the horrific attack. 

No suspects have been named, but new details are slowly emerging in the attack, which killed three and injured at least 176. Two bombs went off just before 3 p.m., shattering a festive atmosphere several hours after the legendary race began on the city’s 238th annual Patriots’ Day. An 8-year-old boy was among the dead and several runners and spectators suffered severe injuries, including severed limbs as the bombs sent shrapnel flying.

“This will be a worldwide investigation,” Special Agent-in-Charge of the FBI’s Boston Field Office Richard DesLauriers said at a Tuesday morning news conference, adding that investigators will go “wherever the leads take us.”

“We will go to the ends of the Earth to identify the suspects responsible for this despicable crime,” he added.

It remained unclear if the bombs were the work of a homegrown or foreign threat, but in Washington, both President Obama and Secretary of Defense Chuck Hagel called the attack terrorism.

“Any time bombs are used to target innocent civilians, it is an act of terror,” Obama said Tuesday morning.

Boston Police Commissioner Ed Davis appealed to the public to come forward with any information or photographic evidence that might help authorities zero in on the killers.

“We’re looking to bring the individuals responsible for this heinous crime to justice,” he said.

Massachusetts Gov. Deval Patrick said the two bombs were the only explosive devices found in the area, discounting prior reports that more unexploded devices had been discovered.

“Two and only two explosive devices were found yesterday,” Patrick said.

Authorities searched an apartment in the nearby Boston suburb of Revere as part of the investigation into the explosions. FoxNews.com saw federal, state and local law enforcement entering the building late Monday night and early Tuesday morning. Sources confirmed to FoxNews.com that the apartment being searched in connection to the bombings is on the fifth floor of the building.

A source close to the investigation confirms to FoxNews.com the man whose apartment was searched is considered a person of interest in the case. He is the same person of interest Fox News confirmed earlier who authorities are guarding at a local hospital. The source stressed that the person of interest is not a suspect, and said he suffered serious injuries in the explosion.

The FBI has a lot of leads and “a lot of work to do” in the investigation, a law enforcement source said. The source said the investigation is “very fluid” and the FBI is looking at many, many people.

Investigators were seen leaving the Revere house early Tuesday carrying brown paper bags, plastic trash bags and a duffel bag, according to the Associated Press.

The Pakistani Taliban, which has threatened attacks in the United States because of its support for the Pakistani government, denied any role in the marathon bombings Tuesday.

The group’s spokesman, Ahsanullah Ahsan, denied involvement in a telephone call with The Associated Press. He spoke from an undisclosed location.

Federal investigators said Monday no one had claimed responsibility for the devastating attack on one of the city’s most famous civic holidays, Patriots’ Day.

At Massachusetts General Hospital, Alasdair Conn, chief of emergency services, said: “This is something I’ve never seen in my 25 years here … this amount of carnage in the civilian population. This is what we expect from war.”

The first two explosions occurred at 2:50 p.m. – nearly five hours after the marathon began – about 50 to 100 yards apart, according to Davis. A third explosion occurred near the John F. Kennedy Presidential Library and Museum in the Columbia Point section of Dorchester, several miles southeast of the marathon’s finish line, at around 4:15 p.m. Police could not say if it was related to the earlier explosions.

The horror unfolded as the city marked the anniversary of the Battles of Lexington and Concord at the beginning of the Revolutionary War. Competitors and race organizers were crying as they fled the bloody chaos, while some witnesses reported seeing victims with lost limbs.

“Somebody’s leg flew by my head,” a spectator, who gave his name as John Ross, told the Boston Herald. “I gave my belt to stop the blood.”

Twenty-six people were transported to Brigham and Women’s Hospital, including a 3-year-old, who was then taken to a children’s hospital. A doctor at the hospital said at least two of the patients there are in critical condition and that some have burns and injuries that will likely require amputations.

“They just started bringing people in with no limbs,” said runner Tim Davey of Richmond, Va. He said he and his wife, Lisa, tried to shield their children’s eyes from the gruesome scene inside a medical tent that had been set up to care for fatigued runners, but “they saw a lot.”

“They just kept filling up with more and more casualties,” Lisa Davey said. “Most everybody was conscious. They were very dazed.”

Witnesses heard booms that sounded like two claps of thunder near the finish line inside the Fairmount Copley Plaza Hotel, according to multiple local reports. Video of the scene showed a number of emergency crews in the area tending to victims and blood on the ground near the finish line.

“I saw two explosions. The first one was beyond the finish line. I heard a loud bang and I saw smoke rising,” Boston Herald reporter Chris Cassidy, who was running in the marathon, told the newspaper. “I kept running and I heard behind me a loud bang. It looked like it was in a trash can or something…There are people who have been hit with debris, people with bloody foreheads.”

“There are a lot of people down,” said one man, whose bib No. 17528 identified him as Frank Deruyter of North Carolina. He was not injured, but marathon workers were carrying one woman, who did not appear to be a runner, to the medical area as blood gushed from her leg. A Boston police officer was wheeled from the course with a leg injury that was bleeding.

About three hours after the winners crossed the line, there was a loud explosion on the north side of Boylston Street, just before the photo bridge that marks the finish line. Another thunderous explosion could be heard a few seconds later.

Runner Laura McLean of Toronto said she heard two explosions outside the medical tent.

“There are people who are really, really bloody,” McLean said. “They were pulling them into the medical tent.”

Cherie Falgoust was waiting for her husband, who was running the race.  ”I was expecting my husband any minute,” she said. “I don’t know what this building is … it just blew. Just a big bomb, a loud boom, and then glass everywhere. Something hit my head. I don’t know what it was. I just ducked.”

Authorities in New York, meanwhile, are deploying counterterrorism vehicles around landmark sites in Manhattan, including prominent hotels, according to the New York City Police Department. 

Nearly 25,000 people, including runners from around the world, competed in Boston’s celebrated 26.2-mile race, attracting huge throngs of onlookers, especially near the finish line.

Hudson announced in April of that year that she and Bellamy were engaged; she gave birth to their son, Bingham, that July. (Bing’s older brother is Ryder, Hudson’s 9-year-old with ex-husband Chris Robinson of the Black Crowes.)

“Well, yes I was shocked, but I also thought: ‘This is going to be interesting,’” Hudson admitted of the unplanned pregnancy and its strain on the new romance. “I knew it would take a strong man to deal with it. You know that with a relationship things can go either way when you have a child.”

Hudson, whose mom is actress Goldie Hawn, continued to praise her man: “When you get pregnant everything changes; you, your body. Everything becomes a big decision, but he was there and that was that.” Although they have yet to wed, the couple are stronger than ever. “Now it’s three wonderful years later. Things happen for a reason,” she says.

The couple have yet to tie the knot — but it will happen. “We will get married. I do think it’s important but we have no plans,” Hudson reveals. “Ryder wants a party.”

Her stance on marriage is largely shaped by her mom Hawn’s 30-year relationship with Kurt Russell, whom she has never legally wed. Instead, Hawn, 67, and Russell, 62, had an unofficial ceremony at home. “We were all together at home, Dad gave Mom a ring and said some beautiful words,” says Hudson, whose biological father is Bill Hudson. “It was their own version of the ceremony and I remember it so well. It was like it was about us. The family was the glue.”

N. Korea threats raise concern Kim backing regime into corner

With the threats billowing out of North Korean dictator Kim Jong Un’s regime at an unusually rapid clip, concern is mounting that the young leader could be backing himself into a corner — feeling compelled to do something or lose face. 

Shortly after midnight local time, North Korean state television reported that Kim signed orders to put the nation’s rockets on combat-ready status. In a photo released on state-run media, a chart titled “U.S. mainland strike plan” could be seen and a map showed missiles arcing into Hawaii, Washington, Los Angeles and Austin, Texas. 

The Pentagon is worried Kim may put himself in a position where he feels he has to act on his threats. 

The North Koreans, while having made progress in their ballistic missile program, still have not mastered the technology of delivering a nuclear device by a long-range missile. But they are making progress, and that is what has the Pentagon concerned. Plus there is the concern that North Korea could strike at South Korea, a top U.S. ally. 

“The North Koreans seem to be headed in a different direction here. So we will unequivocally defend and we are unequivocally committed to that alliance with South Korea, as well as our other allies in that region of the world.  And we will be prepared — we have to be prepared to deal with any eventuality there,” Defense Secretary Chuck Hagel said Thursday. 

Kim warned Friday he is preparing to “settle accounts with the U.S.” after the U.S. deployed B-2 stealth bombers to South Korea to participate in a training exercise Thursday. 

The third-generation dictator’s comments in a meeting with senior generals are part of a rising tide of threats meant to highlight anger over the drills and recent U.N. sanctions over Pyongyang’s nuclear test. 

State media says Kim signed a rocket preparation plan and ordered rockets on standby to strike the U.S. mainland, South Korea, Guam and Hawaii. 

Later Friday at the main square in Pyongyang, tens of thousands of North Koreans turned out for a 90-minute mass rally in support of Kim’s call to arms. 

Men and women, many of them in olive drab uniforms, stood in arrow-straight lines, fists raised as they chanted, “Death to the U.S. imperialists.” Placards in the plaza bore harsh words for South Korea as well, including, “Let’s rip the puppet traitors to death!” 

The U.S. military says the two B-2 stealth bombers sent to South Korea were meant to demonstrate the Pentagon’s commitment to defend its ally against threats from North Korea. 

The two B-2 Spirit bombers flew more than 6,500 miles from Whiteman Air Force Base in Missouri to South Korea, dropping inert munitions before returning to the U.S., according to a statement released by U.S. Forces Korea. 

“The United States is steadfast in its alliance commitment to the defense of the Republic of Korea, to deterring aggression, and to ensuring peace and stability in the region,” the statement said. 

The B-2 Spirit is capable of delivering both conventional and nuclear weapons. The Pentagon said the mission was part of its ongoing Foal Eagle training exercise series, which began March 1 and ends April 30. 

Hagel said Thursday afternoon that the move was part of normal exercises and not intended to provoke a reaction from North Korea. 

The exercise, though, was announced a day after North Korea said it had shut down a key military hotline usually used to arrange passage for workers and goods through the Demilitarized Zone. 

North Korea, which says it considers the U.S.-South Korean military drills preparations for invasion, has pumped out a string of threats in state media. In the most dramatic case, Pyongyang made the highly improbable vow to nuke the United States. 

On Friday, state media released a photo of Kim and his senior generals huddled in front of a map showing routes for envisioned strikes against cities on both American coasts. 

Experts believe the country is years away from developing nuclear-tipped missiles that could strike the United States. Many say they’ve also seen no evidence that Pyongyang has long-range missiles that can hit the U.S. mainland. 

Still, there are fears of a localized conflict, such as a naval skirmish in disputed Yellow Sea waters. Such naval clashes have happened three times since 1999. There’s also the danger that such a clash could escalate. Seoul has vowed to hit back hard the next time it is attacked. 

North Korea’s threats are also worrisome because of its arsenal of short- and mid-range missiles that can hit targets in South Korea and Japan. Seoul is only a short drive from the heavily armed border separating the Koreas. 

“The North can fire 500,000 rounds of artillery on Seoul in the first hour of a conflict,” analysts Victor Cha and David Kang wrote recently for Foreign Policy magazine. They also note that North Korea has a history of testing new South Korean leaders; President Park Geun-hye took office late last month. “Since 1992, the North has welcomed these five new leaders by disturbing the peace,” they wrote.
